Today marks the death of troach on youtube.com

Do I want to mess with this?

    * Why was my video removed for copyright while similar videos were not?

To file a counter notification with us, you must provide a written communication that sets forth the items specified below. Please note that you will be liable for damages (including costs and attorneys' fees) if you materially misrepresent that a product or activity is not infringing the copyrights of others. Accordingly, if you are not sure whether certain material infringes the copyrights of others, we suggest that you first contact an attorney.

Please understand that filing a counter notice may lead to legal proceedings between you and the complaining party to determine ownership, and if your claim is rejected, you may face severe legal and financial penalties.

A sample counter notification may be found at: www.chillingeffects.org/dmca/counter512.pdf.

To expedite our ability to process your counter notification, please use the following format (including section numbers):

    1. Identify the specific URLs of material that YouTube has removed or to which YouTube has disabled access. Include the username of your YouTube account as well.

    2. Provide your name, address, telephone number, email address, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located (or San Francisco County, California if your address is outside of the United States), and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.

    3. Include the following statement: "I swear, under penalty of perjury, that I have a good faith belief that each search result or message identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled."

    4. Sign the paper.

    5. Send the written communication to the following address:

    YouTube, LLC
    Attn: YouTube DMCA Counter Notification
    1000 Cherry Ave
    Suite 200
    San Bruno, CA 94066

    or fax to:

    (650) 872-8513, Attn: YouTube DMCA Counter Notification

What Will Happen If You Upload Infringing Content

Anytime we become aware that a video or any part of a video on our site infringes the copyrights of a third party, we will take it down from the site. We are required to do so by law. If you believe that a video on the site infringes your copyright, send us a copyright notice and we will take it down. If you believe that we have removed a video that you uploaded in error and that you are the copyright owner or have permission, you can file a counter notice and let us know. If you repeatedly post infringing content, your account will be terminated. This is also a requirement of the law.

poy.no has found a way around it:

These clips are here for educational purposes only. They should all be covered by the Fair Use of Copyrighted Materials as codified in section 107 of the copyright law. If you should find that any of these clips violates the Fair Use, please send a letter to Alf B LervÄg, Lars Onsagersvei 7-21A, 7030 Trondheim, NORWAY. This letter should contain the name of the clip that you believe violates the Fair Use and your reasoning for why it violates it. I will then remove the offending clip.

I can't tell which clip or clips caused the problem actually. I had one Day at the Races clip removed by youtube. That one kind of made sense since it was from a well-known/successful Marx Bros film. Peter L. said that he had a Nicholas Bros. clip cut a while back. It doesn't sound like I have much of a leg to stand on, but it is cool that poy.no has not had any trouble with it. (I guess they learned from Natch's experience when he got nailed for copyright infringement years back.)

YouTube (ever since being bought out by Google) has been under the spotlight too much. Better to go with lesser-known, yet still very viable, alternatives (poy.no happens to be a good one)

Mmkay, having checked on youtube, I discovered what troach implied (but did not say). Rather than just having some clip taken down, his entire account was suspended. [Emoticon not found]

Another unpleasant side-effect of this is that the half of the links in the Henry Jenkins article that I posted in "Scholarly Research" are now broken. [Emoticon not found]

What other video sites are viable alternatives to YouTube?

    T_Roach:

I have no idea what happened, but sometime between Friday and now youtube permanently disabled my account.

damn, are you serious? they must seriously be cracking down or something. I wonder if contacting them will do any good?

    peter:

i haVE had clips removed, with email warnings...only to have Minn put it back up with a different name and different key words for the search....

thats how to get around it...use a different title, and dont use real key words to find them. people who know your collection will simply have to find you through other means and so forth...i think thats going to be the way to go...

Poy is my friend in Norway who is a dancer, he has them up on his schools server....lolol

btw, peter is twobarbreak on youtube.com

Oh and minn is this guy and alminns on youtub.com.

I know it, but I'd still rather not have to.

Not that I would like to drive to class from Orem every day, either.

For anyone else in the same boat (is anyone else in the same boat?): my new favorite way to sneak myself a youtube video (and the way I watched bob's last contribution) was to take the URL and replace "http://www.youtube.com/watch?v=" with "http://cache.googlevideo.com/get_video?video_id=".

Actually, it doesn't give you the page, just the .flv file.
